A COURT DECIDES WHAT COUNTS AS A BETREFRAMED ILLUSTRATION

The Facts

  • The 9th U.S. Circuit Court of Appeals ruled 3-0 on Friday that Kalshi cannot block Nevada from overseeing its sports event contracts.
  • The panel said the federal Commodity Exchange Act likely does not preempt Nevada's gaming regulations as applied to those contracts.
  • The court found Kalshi's sports event contracts are sports bets rather than federally regulated "swaps."
  • The three judges on the panel were appointed by President Donald Trump.
  • Circuit Judge Ryan Nelson wrote the opinion.
  • The ruling conflicts with an April decision by the 3rd Circuit holding that New Jersey cannot regulate Kalshi's platform.
  • The split between circuits raises the likelihood the Supreme Court will decide who regulates prediction markets.
  • The panel also rejected an appeal brought by Crypto.com.
  • Kalshi and the Commodity Futures Trading Commission have argued event contracts are federally regulated derivatives.
  • Additional lawsuits over state authority to regulate prediction markets remain pending in other states.

Context

What is a prediction market, and what is a sports event contract?

Prediction markets let users buy and sell contracts whose value depends on the outcome of a future event, such as an election, a Federal Reserve decision, an economic indicator or a sporting event El Observador,CNN Español. Kalshi describes itself as a "designated contract market" offering event contracts it calls swaps, a category of derivative regulated federally by the CFTC Mashable,Axios. Nevada and other states argue that contracts tied to sports outcomes are, in substance, sports bets subject to state gambling law Aol,Clarin.

Why does a disagreement between two appeals courts matter?

The 9th Circuit's ruling directly contradicts the 3rd Circuit's April decision that New Jersey lacks authority over Kalshi's platform, leaving the law different in different parts of the country CNBC,Investing.com,Investing.com. A split among circuits is often a key factor in the Supreme Court's decision to take up a case, and federal regulators and legal experts have said the question will likely be resolved there NBC Sports,CNN International.

What is the immediate practical effect for Kalshi in Nevada?

The panel refused to let Kalshi restart trading on sports and elections events in Nevada while it contests the state's effort to shut it down until it obtains a license from state gambling regulators U.S. News & World R…,Star. Nevada's Gaming Control Board had earlier sent Kalshi a cease-and-desist letter asserting it was operating a sports betting platform in violation of state gaming rules Mashable,Ars Technica.

Where Left and Right agree, and where they split

Left and right largely agree on this one.

Where Left and Right agree
Both read the 3-0 ruling as correct: Kalshi's sports event contracts are bets, and Nevada's gaming regulators keep authority unless Congress explicitly says otherwise.
Where Left and Right differ in emphasis
Both endorse state oversight; one because sports betting drains people who can least afford losses, the other because preemption must be proved, not presumed.
Why they won’t converge
The divide is about what state authority is *for* — one side treats gambling law as consumer protection owed to bettors, the other as a federalism default Congress never displaced — so a shared outcome today leaves the underlying question untouched.

How left and right read it

Left says

States built gambling oversight because sports betting extracts money from people who can least afford to lose it, and a company does not get to shed that protection by calling a bet a derivative. Three Trump-appointed judges said so unanimously, finding these contracts are sports bets rather than swaps, which is notable given the pressure reportedly applied to Republican attorneys general to leave such platforms alone. The burden belongs on the platform, not the public.

“Donald Trump Jr., the president's son, told Republican state attorneys general at a meeting earlier this year to back off any action against businesses like Kalshi and Polymarket.” — The New Republic↗

Right says

Preemption must be proved, not presumed. Before federal regulators can displace state gaming law, they have to show Congress said so — and three Trump-appointed judges found the Commodity Exchange Act likely does not, because these contracts are sports bets rather than swaps. That restraint matters most when federal power is being pressed on behalf of a well-connected industry; keep the default with the states unless Congress itself changes it.

“A nationwide legal fight over prediction markets has escalated into a confrontation between the Trump administration and dozens of states, as federal regulators aggressively defend an industry in which President Donald Trump's family has financial interests” — NewsMax↗
